Justin Bieber Arrested for DUI

Justin Bieber was arrested in Miami Beach and charged with DUI, resisting arrest and having an expired driver’s license.

The pop star was busted after he was observed drag racing at 4:13 a.m. on Thursday. This is the first time Bieber has been arrested.

Fellow musician Khalil Sharieff was the other drag racer, driving a red Ferrari. Sharieff was also arrested for DUI and found to be under the influence of alcohol and drugs (see his mugshot at the end of this story).

Bieber, 19, was in a yellow Lamborghini when he was pulled over. A police officer noticed his and Sharieff’s cars drag racing, according to the arrest report. The officer also noticed that there were black SUVs behind both cars as if to create a makeshift racetrack. During the race, Bieber’s and Sharieff’s vehicles reached speeds of 55 to 60 mph in a residential area where the speed limit is 30 mph. The officer stopped Sharieff’s car and another officer later caught up with Bieber’s car.

When the officer approached Bieber’s car, he smelled a strong odor of alcohol and noticed Bieber’s eyes appeared to be bloodshot, the arrest report states. Bieber also had slow, deliberate movements and a look of stupor on his face, all of which are indicators of an impaired driver. The arrest report, which also notes that Bieber had a flushed face, states that the pop star was found to be under the influence of alcohol, but it’s unclear whether he was also under the influence of drugs.

Bieber resisted arrest, questioning why he was being stopped, and was arrested for resisting and not following his instructions. After Bieber exited the vehicle, he repeatedly questioned what was going on, in obscene terms, and he kept putting his hands in his pockets despite the police officer’s asking him not to out of fear he was going for a weapon. Bieber resisted three attempts to pat him down for weapons, saying “I ain’t got no f—ing weapons,” “Why do you have to search me?” “What the f— is this about?” and “What the f— are you doing?”

He was then placed into custody and taken to the police station. En route, Bieber said he wasn’t drunk and was coming back from recording music at a studio.

At the station, Bieber said that he had consumed alcohol and some prescription medication and had been smoking pot, Miami Beach Police Chief Raymond Martinez said in a press conference (video below).

Bieber was cooperative at the police station but failed a field sobriety test and was given a Breathalyzer test.

Bieber had a blood-alcohol level of 0.04, according to various media reports. But TMZ reported Friday that the pop star may have only had a blood-alcohol level of 0.014.

Under Florida law, people under the age of 21 are considered driving under the influence if they have a blood-alcohol content of .02 percent or more — a level Bieber could reach with one drink.

The street where Bieber was racing is a four-lane residential street containing apartment buildings, a high school, a youth center, a golf course and a city firehouse, according to the Associated Press. It’s a short drive away from South Beach.

Bieber was leaving a club at the time, according to The Miami Herald.

Bieber and his friend did not blow a significant amount on the Breathalyzer test, the Herald reports, but they were arrested for driving under the influence after failing drug recognition tests.

He also posted the below photo on Instagram of Bieber allegedly in the Lamborghini before he was arrested.

The Herald adds that Bieber is reported to have spent tens of thousands of dollars at the King of Diamonds strip club.

The club tweeted on Monday night that Bieber ordered $75,000 in singles.

However, club owner Ricky “Disco Rick” Taylor later said that Bieber didn’t spend all of that money.

“Justin Bieber didn’t spend $75,000,” Taylor said during an appearance on The Andy Slater Show Wednesday afternoon on sports radio WINZ-940 AM, according to The Miami Herald.

“First of all, he stayed for an hour,” continued Taylor. “If he dropped $75K, he’d have been here for three or four hours.”

The Opa-Locka Police Department is also reportedly investigating a police escort given to Bieber.

The arrest is the latest run-in with the law for Bieber, whose house was searched last week after he was accused of egging a neighbor’s house and videotaping the incident. Bieber is still under investigation over the egg-throwing incident, but his Miami arrest is unlikely to affect that, the AP reported.

Bieber also has repeatedly been cited for speeding, openly smoking pot and hosting loud parties at his Calabasas home. In addition, the pop star recently made headlines for allegedly sneaking out of a Brazilian brothel, illegally tagging a hotel wall and urinating into a mop bucket while yelling “F— Bill Clinton” and desecrating a photo of the former president.

Bieber is scheduled to go to trial in L.A. on Feb. 18 for allegedly beating up his ex-bodyguard Moshe Benabou.

Late Thursday, Bieber’s manager, Scooter Braun, took to Twitter to address the arrest.

Braun also posted a quote on Instagram: “What defines us is how well we rise after falling.”

In a recent THR cover story, Braun, said that while he tried to protect the pop star when he was younger, he now finds he can’t control him.

“When Justin was younger, it was ‘Keep him out of trouble, stop him from falling down, protect him as much as you can from anything that can hurt him,’ ” Braun told THR. “When I try to do that now, he’s resentful, he pushes away and rebels. What I’ve come to learn is: Be there, give the best advice you can, but he has to be allowed to make his own decisions — and his own mistakes.”

But Braun said he does still wait up for Bieber to go to sleep.

“I’m usually up pretty much all night until I know Justin is in,” the manager told THR. “At night is when trouble can come.”

Braun added that he’s “prepared for what may come,” in terms of morning news about his client.

Bieber, who’s Canadian, is living in the U.S. thanks to an O-1 visa, issued to anyone with “extraordinary ability or achievement” in their field, including the arts.

Any conviction for an aggravated offense could see Bieber’s work visa revoked, prompting immigration officials to toss him out of the country.   

But the Miami arrest likely won’t affect Bieber’s immigration status, according to the AP.

According to U.S. immigration law, authorities do not revoke an individual’s visa unless the person has been convicted of a violent crime or been sentenced to more than one year imprisonment.

According to immigration attorney Ira Kurzban, Bieber is “not subject to deportation because of a DUI offense, nor is driving with an expired license a deportable offense.” Those offenses wouldn’t keep Bieber from being readmitted into the U.S., either.

For a first DUI offense, there is no minimum sentence and a maximum of six months, a fine of $250 to $500, and 50 hours of community service. For anyone under 21, there is an automatic six-month license suspension.

A first conviction for drag racing carries a sentence of up to six months, a fine of $500 to $1,000 and a one-year license suspension.

Beiber’s publicist declined to comment.
