Ride-sharing services, such as Uber, have found a niche in the Philippine transportation industry... more Ride-sharing services, such as Uber, have found a niche in the Philippine transportation industry by offering services superior to taxicabs at competitive prices, and by exploiting a gap in our laws that allow them to operate at minimal costs. Traditional regulatory approaches are proving to be inadequate because the established framework, conceived over a century ago, did not foresee the amalgamation of mobile telecommunications and public transportation. Considering its public safety implications, the question for the legislature is not whether to regulate the industry but to determine the intensity of the regulation. The article proposes a co-regulatory approach in order to find a middle ground between nurturing new economies and creating legal protections for the riding public. But the bigger challenge for legislators is to avoid the pitfall of force-fitting modern businesses into the traditional framework.
