The Secretary of State, in exercise of the powers conferred on him by sections 33(3) and 74(6) of the Environmental Protection Act 19901 (having in particular had regard in exercising his powers under section 33(3) to the matters specified in section 33(4) of that Act), and of all other powers enabling him in that behalf, hereby makes the following Regulations:
