The Order adds requirements for rent officers to make determinations for prospective tenancies and licences (article 2), to determine local reference rents (paragraph 4 of Schedule 1) and to determine indicative rent levels (Part 4 of Schedule 1). It removes the requirement for rent officers to make interim determinations. The Rent Officers (Additional Functions) Order 1995Sch.1 Pt.I para.4(2)(b)The Rent Officers (Additional Functions) (Amendment No. 2) Order 1995art.2(a)(i)The Rent Officers (Additional Functions) Order 1995Sch.1 Pt.I para.4(2)(b)(ii)The Rent Officers (Additional Functions) (Amendment No. 2) Order 1995art.2(a)(ii)The Rent Officers (Additional Functions) Order 1995Sch.1 Pt.I para.4(3A)The Rent Officers (Additional Functions) (Amendment No. 2) Order 1995art.2(a)(iii)The Rent Officers (Additional Functions) Order 1995Sch.1 Pt.2 para.7(2)The Rent Officers (Additional Functions) (Amendment No. 2) Order 1995art.2(b)The Rent Officers (Additional Functions) Order 1995Sch.1 Pt.4 para.9(3)(d)(e)(f)(g)(h)The Rent Officers (Additional Functions) (Amendment No. 2) Order 1995art.2(c)(i)- (v)The Rent Officers (Additional Functions) Order 1995Sch.1 Pt.4 para.9(5) (defn. of room)The Rent Officers (Additional Functions) (Amendment No. 2) Order 1995art.2(c)(vi)The Rent Officers (Additional Functions) Order 1995art.5(4)The Rent Officers (Additional Functions) (Amendment) Order 1996art.3The Rent Officers (Additional Functions) Order 1995Sch.1 Pt.I para.4AThe Rent Officers (Additional Functions) (Amendment) Order 1996art.4The Rent Officers (Additional Functions) Order 1995Sch.1 Pt.2 para.7(2)The Rent Officers (Additional Functions) (Amendment) Order 1996art.5The Rent Officers (Additional Functions) Order 1995Sch.1 Pt.3 para.8(2)The Rent Officers (Additional Functions) (Amendment) Order 1996art.6The Rent Officers (Additional Functions) Order 1995art.5(4)The Rent Officers (Additional Functions) (Amendment) Order 1996art.3The Rent Officers (Additional Functions) Order 1995Sch.1 Pt.I para.4AThe Rent Officers (Additional Functions) (Amendment) Order 1996art.4The Rent Officers (Additional Functions) Order 1995Sch.1 Pt.2 para.7(2)The Rent Officers (Additional Functions) (Amendment) Order 1996art.5The Rent Officers (Additional Functions) Order 1995Sch.1 Pt.3 para.8(2)The Rent Officers (Additional Functions) (Amendment) Order 1996art.6The Rent Officers (Additional Functions) Order 1995art.5(4)The Rent Officers (Additional Functions) (Amendment) Order 1997arts.2(a)3(1)The Rent Officers (Additional Functions) Order 1995Sch.3 para.1The Rent Officers (Additional Functions) (Amendment) Order 1997arts.2(b)3(2)The Rent Officers (Additional Functions) Order 1995art.5(3)The Rent Officers (Additional Functions) (Amendment) Order 1995art.3(a)The Rent Officers (Additional Functions) Order 1995Sch.1 Pt.3 para.8(2A)The Rent Officers (Additional Functions) (Amendment) Order 1995art.3(b)The Rent Officers (Additional Functions) Order 1995art.5(4)The Rent Officers (Additional Functions) (Amendment) Order 1997arts.2(a)3(1)The Rent Officers (Additional Functions) Order 1995Sch.3 para.1The Rent Officers (Additional Functions) (Amendment) Order 1997arts.2(b)3(2)The Rent Officers (Additional Functions) Order 1995revokedThe Rent Officers (Housing Benefit Functions) Order 1997arts.2-79The Rent Officers (Additional Functions) Order 1995revokedThe Rent Officers (Housing Benefit Functions) Order 1997arts.2-79The Rent Officers (Additional Functions) Order 19951Citation and commencement2Interpretation3Determinations4Redeterminations5Exceptions6Special cases7Revocations8ApplicationSCHEDULE 1PART 1DETERMINATIONS1Significantly high rents2Size and rent3Exceptionally high rents4Local reference rents5ServicesPART 2ASSUMPTIONS etc.6Medical, nursing and other care services7Housing associations etc.PART 3NOTIFICATIONS OF PART I DETERMINATIONS8NotificationsPART 4INDICATIVE RENT LEVELS9(1) The rent officer shall determine the indicative rent level...SCHEDULE 2SIZE CRITERIA1One bedroom or room suitable for living in shall be...2The number of rooms (excluding any allowed under paragraph 1)...SCHEDULE 3REDETERMINATIONS1Schedules 1 and 2 shall apply in relation to a...2The rent officer making the redetermination shall seek and have...SCHEDULE 4SPECIAL CASES1Houseboats2Mobile homes3Rental purchase agreements1995 No. 1642HOUSING, ENGLAND AND WALESThe Rent Officers (Additional Functions) Order 1995Made28th June 1995Laid before Parliament29th June 1995Coming into force2nd January 1996The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred upon them by section 121(1) and (2) of the Housing Act 1988, and of all other powers enabling them in that behalf, hereby make the following Order.1988 c. 50; section 121(1) was amended by section 110(3) of the Local Government and Housing Act 1989 (c. 42).
